1. Agreement to these terms.

These terms apply to use of the website operated by Vera Mental Health & Wellness, Professional Nursing Corporation, referred to as Vera, we, us, or our. By using the website, you agree to these terms. If you do not agree, do not use the website.

2. Informational website only.

The website provides general information about Vera and available services. The website does not provide medical advice, psychiatric advice, diagnosis, treatment, psychotherapy, crisis intervention, or emergency services. Website content is not a substitute for evaluation by a qualified healthcare professional.

3. No provider-patient relationship from website use.

Viewing the website, submitting a form, requesting a consultation, leaving a message, or receiving an administrative response does not create a provider-patient relationship. A provider-patient relationship is formed only after Vera accepts the person as a patient, completes required intake and consent processes, determines that the requested services are clinically and legally appropriate, and provides clinical services through an authorized clinician.

4. Book a Consultation page.

The Book a Consultation page allows a person to submit contact information and a short request so Vera can respond. Submission of a request does not guarantee an appointment, acceptance as a patient, prescription, particular treatment, or suitability for telehealth. Vera may decline services when the request is outside the practice scope, the person is located outside a state where the treating clinician may practice, telehealth is not appropriate, the person requires urgent or higher-level care, or services are otherwise unavailable or inappropriate.

5. Do not use the website for emergencies.

Do not use the website, booking page, contact form, email, voicemail, text message, or portal message for emergencies or urgent clinical needs. If you may harm yourself or someone else, are in psychiatric crisis, have a medical emergency, have a severe medication reaction, or need immediate help, call 911, go to the nearest emergency room, or call or text 988 for the Suicide and Crisis Lifeline. Vera does not guarantee immediate review of website submissions or messages.

6. Telehealth limitations.

Telehealth may not be appropriate for every patient, condition, medication, or clinical situation. Vera may require in-person care, emergency care, a higher level of care, or referral to another provider. The patient must be physically located in a state where the treating clinician is licensed or otherwise authorized to provide services at the time of the encounter.

7. Accurate information.

You agree to provide accurate and complete information. You may not impersonate another person, submit false information, interfere with website operation, attempt unauthorized access, or use the website for unlawful purposes.

8. Minors.

The website is not intended for use by minors without the involvement of a parent, legal guardian, or other authorized representative when required by law. Vera provides services to adults aged 18 and older and does not currently accept minors as patients.

9. No guarantee.

Vera does not guarantee clinical outcomes, appointment availability, medication prescribing, insurance coverage, or acceptance as a patient. Services and website content may change without notice.

10. Prescriptions and controlled substances.

Website content does not guarantee that any medication will be prescribed. Medication decisions are made by the treating clinician based on clinical judgment, patient safety, professional standards, identity and location verification, applicable law, prescription drug monitoring program review when required, and other relevant facts. Controlled substances, if prescribed at all, are subject to additional requirements.

11. Payment and insurance information.

Website statements about fees, payment, insurance, or billing are general and may change. Payment, insurance, and financial responsibility are governed by the applicable patient financial policy, payer rules, and law.

12. Communications.

By submitting a contact form or consultation request, you authorize Vera to contact you using the information provided. Standard text and data rates may apply. Ordinary email and text messages may not be encrypted. Do not send highly sensitive information through unsecured channels unless you understand and accept the risk or the form is provided through a secure system.

13. Intellectual property.

The website and its content are owned by Vera or its licensors. You may view the website for personal, noncommercial use. You may not copy, modify, distribute, scrape, sell, or exploit website content without written permission, except as allowed by law.

14. Third-party links and tools.

The website may link to third-party websites, scheduling tools, payment tools, portals, forms, analytics tools, or other services. Vera is not responsible for third-party websites or services. Use of third-party services may be governed by their own terms and privacy policies.

15. Disclaimers.

The website is provided as-is and as-available. Vera does not warrant that the website will be uninterrupted, error-free, secure, or current. To the maximum extent allowed by law, Vera disclaims warranties not expressly stated in these terms.

16. Limitation of liability.

To the maximum extent allowed by law, Vera is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from use of the website. Nothing in these terms limits rights that cannot be limited under applicable law.

17. Changes to these terms.

Vera may revise these terms by posting updated terms on the website. Continued use of the website after the effective date of revised terms means you accept the revised terms.

18. Governing law.

These terms are governed by California law, without regard to conflict-of-law rules, except to the extent federal law controls.

1. Scope of this notice.

This notice describes information collected through the public website and the Book a Consultation page. If Vera creates, receives, maintains, or transmits information as protected health information in connection with treatment, payment, or healthcare operations, Vera also handles that information under its HIPAA Notice of Privacy Practices and applicable California medical privacy laws.

2. Information collected.

Vera may collect information submitted through the website, such as name, phone number, email address, preferred contact method, reason for requesting contact, appointment request details, insurance or payment information if requested, and other information submitted by the user. The website may also collect technical information such as IP address, device information, browser type, pages viewed, referring site, and cookie or analytics information.

3. Use of information.

Vera may use website information to respond to requests, schedule consultations, determine whether services may be appropriate, operate the website, maintain security, document communications, improve administrative workflows, and comply with law.

4. Sharing of information.

Vera may share information with service providers that support the website, scheduling, communications, analytics, hosting, security, billing, or practice operations, subject to applicable agreements where required. Vera may also disclose information when required by law, to protect safety or rights, or in connection with business or legal obligations.

5. Security.

Vera uses reasonable safeguards for website and contact-form information. No website, form, email, text message, or internet transmission is completely secure. Users should avoid submitting unnecessary sensitive information through unsecured channels.

6. No emergency monitoring.

Website forms and messages are not monitored as emergency channels. Do not use them for urgent clinical needs.

This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

1. Our duties.

Vera is required by law to maintain the privacy of protected health information, give this notice of legal duties and privacy practices, follow the terms of the notice currently in effect, and notify affected individuals after a breach of unsecured protected health information when notice is required by law.

2. Who follows this notice.

This notice applies to Vera and its workforce, including clinicians, employees, contractors, trainees, volunteers, and others who help provide services or support treatment, payment, or healthcare operations for Vera.

3. Treatment.

Vera may use and disclose your health information for treatment. This may include sharing information with your treating clinician, pharmacies, laboratories, other healthcare providers, hospitals, emergency providers, therapists, consultants, care coordinators, or others involved in your care.

4. Payment.

Vera may use and disclose your health information for payment. This may include billing you, your health plan, or another responsible payer; verifying coverage; collecting payment; processing claims; and responding to payer questions.

5. Healthcare operations.

Vera may use and disclose your health information for healthcare operations. This may include quality review, compliance, licensing, credentialing, training, audits, legal services, business management, technology support, patient communications, and other operations needed to run the practice.

6. Appointment reminders and communications.

Vera may contact you about appointments, treatment, payment, healthcare operations, benefits, services, or administrative matters. Communications may occur by phone, portal, email, text, mail, or other method you provide or authorize, subject to practice policy and applicable law.

7. Business associates.

Vera may share information with vendors and service providers that perform functions for Vera, such as EHR, telehealth, billing, scheduling, IT, payment processing, document storage, legal, accounting, or compliance support. Vera requires business associate agreements when required by HIPAA.

8. Uses and disclosures required or permitted by law.

Vera may use or disclose information when required or permitted by law, including for public health activities, health oversight, abuse or neglect reporting, judicial or administrative proceedings, law enforcement, coroners or medical examiners, organ donation, workers compensation, threats to health or safety, specialized government functions, and other legally permitted purposes.

9. Emergencies and safety.

Vera may disclose information when necessary to prevent or lessen a serious and imminent threat to health or safety, or when otherwise permitted or required by law.

10. Family, friends, and others involved in care.

Vera may share information with a family member, friend, caregiver, personal representative, or other person involved in your care or payment if you agree, if you do not object when given the opportunity, or if Vera determines based on professional judgment that disclosure is in your best interest and permitted by law.

11. Psychotherapy notes.

Psychotherapy notes, if created and maintained separately from the medical record, receive special protection. Vera generally will not use or disclose psychotherapy notes without your written authorization, except as permitted by law.

12. Substance use disorder information.

If Vera creates or receives records subject to 42 C.F.R. Part 2, those records may receive additional protections. Vera will handle Part 2 records as required by applicable law. Vera is not a Part 2 program and does not expect to maintain Part 2 records; if Vera receives such records, it will protect them as required.

13. Reproductive health information.

Vera will apply applicable federal and California privacy rules for reproductive health information when such information is involved.

14. Uses and disclosures requiring authorization.

Vera generally must obtain your written authorization for uses and disclosures not described in this notice or otherwise permitted by law. This includes most uses and disclosures of psychotherapy notes, marketing communications requiring authorization, and sale of protected health information. You may revoke an authorization in writing, except to the extent Vera has already relied on it.

15. Right to inspect and obtain a copy.

You may ask to inspect or receive a copy of your medical record and certain other health information. Vera may charge a reasonable, cost-based fee when permitted by law. Vera may deny a request in limited circumstances and will explain rights to review when applicable.

16. Right to request amendment.

You may ask Vera to amend health information you believe is incorrect or incomplete. Vera may deny the request in certain circumstances, including when the information was not created by Vera, is not part of the designated record set, is accurate and complete, or is not available for inspection.

17. Right to an accounting of disclosures.

You may request an accounting of certain disclosures of your health information. The accounting does not include all disclosures, such as disclosures for treatment, payment, healthcare operations, disclosures made to you, disclosures authorized by you, or disclosures otherwise excluded by law.

18. Right to request restrictions.

You may request limits on uses or disclosures of your health information. Vera is not required to agree to most restrictions. If you pay out of pocket in full for a service and ask Vera not to disclose that service to your health plan for payment or healthcare operations, Vera will honor that request unless disclosure is required by law.

19. Right to request confidential communications.

You may ask Vera to contact you in a specific way or at a specific address. Vera will accommodate reasonable requests.

20. Right to a paper copy.

You may request a paper copy of this notice at any time, even if you agreed to receive it electronically.

21. Complaints.

You may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights. Vera will not retaliate against you for filing a complaint.

22. Changes to this notice.

Vera may change this notice. Revised notices may apply to information Vera already has and information received in the future. Vera will post the current notice on its website if it maintains one and will make copies available on request.
